1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the website operated at www.mindfulcrumb.com (“the Site”) and the purchase of products from CRUMB ORIGEN LDA (trading as “MindfulCrumb”), registered in Portugal with VAT number 518 237 560, with registered office at Rua Santa Anastacia 20, 4150-664 Porto, Portugal.

By using this Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Products & Descriptions

We make every effort to ensure product descriptions, images, and nutritional information are accurate. However, we do not warrant that descriptions are error-free. Colours may appear differently depending on your device. If a product you receive differs materially from its description, you are entitled to return it in accordance with our returns policy.

Our products are food supplements and snacks. They are not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional before using any supplement, particularly if you are pregnant, nursing, or have a medical condition.

3. Pricing & Payments

All prices are listed in Euros (EUR) and include applicable VAT. We reserve the right to change prices at any time without prior notice. The price at the time you place your order is the price you pay.

Payments are processed securely through Shopify Payments. We accept major credit and debit cards, as well as other payment methods available at checkout. We do not store your payment card details.

4. Orders & Fulfilment

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including stock availability, pricing errors, or suspected fraud. If your order is cancelled, you will receive a full refund.

Orders are processed within 1–3 business days. Delivery times depend on your location and the shipping method selected. Estimated delivery times are provided at checkout but are not guaranteed.

5. Shipping

We ship across the European Union. Shipping costs and estimated delivery times are calculated at checkout based on your delivery address. Free shipping may be offered on orders above a certain threshold, as indicated on the Site.

Risk of loss and title for items purchased pass to you upon delivery. We are not responsible for delays caused by customs, postal services, or other circumstances beyond our control.

6. Returns & Refunds

Under EU consumer law, you have the right to cancel your order within 14 days of receiving your goods, without giving any reason. To exercise this right, contact us at hello@mindfulcrumb.com with your order number.

Items must be returned in their original, unopened condition. For food safety reasons, we cannot accept returns on opened food products unless they are defective. Return shipping costs are the responsibility of the customer unless the product is defective or we made an error.

Refunds will be processed within 14 days of receiving the returned item, using the same payment method used for the original purchase.

7. Intellectual Property

All content on this Site — including text, images, logos, graphics, design, and software — is the property of CRUMB ORIGEN LDA or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CRUMB ORIGEN LDA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal, without prejudice to any mandatory consumer protection provisions in your country of residence.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
